FAQs

  1. How can I retrieve my property?

If your item was taken and logged as evidence in a case, it will remain in our custody until the court process is complete and a verdict has been reached, provided charges
have been filed with the District Attorney’s Office. For cases where no charges were filed, the item will be held in accordance with the statute of limitations, which typically
ranges from 1 to 3 years. Please note that certain serious offenses, such as homicide and child sexual assault, do not have a statute of limitations. Additionally, some property
may not be eligible for return due to federal, state, or local laws and our internal policies and procedures.

  2. How will I know when my property is ready for pickup?

You will receive a notification by postal mail from the LCSO Evidence Unit, indicating that your property is available for collection. This letter will also guide you to schedule an appointment through our booking page. To ensure you receive all communications promptly, please verify that the address listed on your driver's license or ID card is up-to-date. If you have not yet received a notification from us, please be assured that this indicates your item is not yet available for release. We kindly request that you do not arrive without a scheduled appointment, as we cannot guarantee that your item will be ready for pickup.

  3. My case has concluded, and I have been sentenced. Why haven’t I been contacted regarding my property?

The timeline for returning property can vary based on several factors. These include the status of any co-defendants with ongoing cases, obtaining necessary documentation from the District Attorney’s Office, following court orders, completing our internal review processes, and adhering to laws and policies regarding the release of items. We appreciate your patience as we work through these considerations.

  4. What is the timeline for picking up my property?

In the notification letter you receive, we will specify the deadline for property pickup. Generally, you will have between 30 and 90 days to collect your property once it is deemed releasable. The exact timeframe depends on whether the item was taken for safekeeping or as evidence in a crime.

  5. What should I do if I miss the pickup deadline?

If you miss the pickup deadline, do not attend a scheduled appointment, or fail to reach out after receiving our notification, your property will be deemed abandoned. Subsequently, LCSO may dispose of the property without further notice or compensation.

  6. Who is contacted concerning property pickup?

We will reach out directly to the individual listed as the owner of the item. Unfortunately, we cannot initiate contact with spouses, children, parents, siblings, or friends, except in certain circumstances. For example, if the owner is a juvenile, we will communicate with both the owner and their parents/guardians. If the owner has passed away, we will contact the designated next of kin as identified by will or state law.

  7. What if I wish to pick up an item that does not belong to me?

To retrieve an item on someone else’s behalf, you will need to provide a notarized statement or notarized power of attorney. Please note that this requirement does not cover firearms, as specific restrictions govern their release.

  8. How can I report or provide evidence of a crime?

If you wish to report a crime or submit evidence, please contact our Dispatch Unit. They are equipped to assist you and will assign a case officer to handle your concerns.
